EquityCube (“the website”) is an online tool for receiving and processing equity release applications and is operated by Lightstate Ltd, (Company Number 465385, Registered Address: Shropshire House, 11-20 Capper Street, London WC1E 6JA). A wholly owned subsidiary of Platform-A. Where ‘we’ or ‘our’ or ‘us’ is used in these Terms and Conditions, this refers to Lightstate Limited.

Lightstate Limited may make alterations to these terms and conditions from time to time and these variations shall become effective immediately upon being published here.

You may wish to review updates to these terms and conditions periodically as they are subject to change at any point, and without warning.


About EquityCube

EquityCube collects data from users and passes this on where applicable, without alteration, and after user approval, to our chosen third parties, as clearly stated to the user during the data submission process and at the end of the equity release application process.

You agree and accept that Lightstate Limited has no responsibility to review the content of the communications on the website all of which are made available on the basis that Lightstate Limited shall not be required to exercise any control or judgment of the content or the material posted or contained therein.

Third party websites with links from EquityCube have not been verified or reviewed by Lightstate Limited, and use and access of such third party websites is at your own risk.

You acknowledge and agree that Lightstate Limited does not act in any way as your agent or as the agent for any of the third party organisations and services featured on the website.

Lightstate Limited makes no warranties, nor can it assume any responsibility for the following:

• the accuracy, comprehensiveness, suitability or currency of the content of any third party material featured (whether or not this information is identified by Lightstate Limited as being from a third party)
• the quality of service offered by any third party featured on the website, or recommended by Lightstate Limited on the website

Lightstate Limited is engaged in the marketing and supply of third party information relating to the finance industry – including in relation to equity release and other financial services.

Lightstate Limited is not authorized by the FSA (Financial Services Authority) in relation to the supply of advice in relation to financial products and should not be considered to be a financial advisor.

Lightstate Limited cannot accept any responsibility for any issues arising as a result of your communication or contrfact with any third party mentioned or recommended on EquityCube.

Many third party service providers will request that you are subject to their Terms and Conditions. Those Terms and Conditions are entirely separate to these Lightstate Limited Terms and should be treated accordingly.

Before entering into any agreement with a third party we recommend that you read their Terms and Conditions very carefully and seek independent advice where necessary.

Lightstate Limited may receive commission or fees as a result of your use of the services of third party providers featured on the website. We do not charge you for the services that we offer. These commissions or fees do not indicate an agency relationship between Lightstate Limited and third party financial product or service providers, nor any involvement in any contract that you form with that third party provider.

To the extent permitted by law Lightstate Limited excludes liability for all inaccuracies present on the website.


Copyright, Intellectual Property Rights and Trade Marks

All copyright, design rights, database rights, patents, and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any applications therefore (Intellectual Property Rights) in the website belong to and vest in Lightstate Limited, or are licensed to Lightstate Limited unless otherwise specified. All such rights of Lightstate Limited are hereby asserted and reserved.

• display, publish, copy, print, post or otherwise use the website and the information contained therein for the benefit of any other website without Lightstate Limited’s or the relevant licensee’s prior written permission;
• process or otherwise use the information contained on or within the website for any illegal or immoral purpose nor use or process the same unfairly.

Liability Obligations

Lightstate Limited provides and maintains the website for personal information and community purposes, on an ‘as is’ basis. Lightstate Limited shall be liable only to provide its services with reasonable skill and care and gives no other warranty in connection with the website.

Lightstate Limited excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, punitive or consequential loss whether or not such arises out of any problem you notify to Lightstate Limited and Lightstate Limited shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

• any incorrect or inaccurate information on the Website and all interruptions to or delays in updating the service;
• the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website;
• any amount or kind of loss or damage due to viruses or other malicious software that may infect a user’s computer equipment, software, data or other property caused by persons accessing, using or downloading the website, or from transmissions via emails or attachments received from Lightstate Limited or its licensees;
• the availability, quality, content or nature of the other sites on the internet that are owned and operated by third parties (“External Sites”) which are linked to from EquityCube. Any questions, problems or complaints regarding the content or use of other sites or companies linked to from ‘The website’ should be taken up with said third party.
• all representations, warranties, conditions and other terms which but for this notice would have effect.
• Lightstate Limited have used all reasonable efforts to ensure that all information provided by it is accurate and accords with current standards however it cannot account for the accuracy of information posted by users of the Website.

Agreement Termination

Lightstate Limited shall be entitled to terminate this Agreement and immediately remove, cancel or suspend access to and use of the website upon your breach of any part of these Terms whatsoever.

Termination shall be without prejudice to the accrued rights of either party.

Lightstate Limited will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communications outages, fire, flood, war or act of God.

If Lightstate Limited does not enforce any provision of this agreement such will not be considered a waiver of any provision or right.

These Terms and Conditions constitute the entire agreement between you and Lightstate Limited and shall apply to the exclusion of all other terms or conditions of contract which you may purport to propose.

Use of EquityCube and these terms are subject to the laws of England which shall exclusively govern the interpretation, application and effect of all the above permissions, exclusions, licenses and conditions of use and shall be construed in accordance with the laws of England and the parties submit to the exclusive jurisdiction of the English courts.

It is hereby asserted that the website is intended for and directed at the UK and no representation or warranty is made as to whether the website complies with the regulatory regime and local laws of any other countries.
